The content, features, and services provided by the Aslyte Nutrition application ("the App"), including but not limited to meal plans, recipes, calorie and macronutrient tracking, nutritional recommendations, weight management programs, supplement information, and health metric tracking, are intended for general informational and educational purposes only. Nothing contained in the App constitutes, is intended to constitute, or shall be construed as:

• medical advice, diagnosis, or treatment;

• dietetic or nutritional counselling provided by a licensed professional;

• a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider; or

• a recommendation or endorsement of any specific diet, product, supplement, course of action, or healthcare provider.

You should never disregard professional medical advice or delay seeking medical treatment because of information you have accessed through the App.

2. No Professional Review of Content

The nutritional information, meal plans, recipes, and recommendations provided within the App have not been created, reviewed, verified, or approved by a licensed physician, registered dietitian, certified nutritionist, or any other licensed healthcare professional. The content is generated through algorithmic processes, editorial research, and rule-based recommendation systems and may not reflect the most current medical or nutritional research, guidelines, or standards.

Users are strongly advised to consult a qualified healthcare professional before making any changes to their diet, exercise routine, or supplement intake, particularly if they have any pre-existing medical conditions or are taking medication.

3. Algorithmic and AI-Generated Content

Portions of the App's content, including personalised recipe recommendations and calorie and nutrition recommendations, are generated by automated algorithms, including search-based and rule-based recommendation systems. Such algorithmically generated content:

• is produced without human professional oversight at the point of delivery;

• may contain inaccuracies, errors, or omissions;

• is based on general data models and user-provided inputs that may not fully reflect your individual nutritional needs, health status, or medical history;

• should not be relied upon as a sole basis for dietary, health, or fitness decisions; and

• does not account for interactions with medications, undisclosed health conditions, or complex metabolic requirements.

Aslyte UG does not warrant the accuracy, completeness, reliability, or suitability of any algorithmically generated content for any particular purpose.

4. Nutritional Information Accuracy

Nutritional values, calorie counts, macronutrient data, and ingredient information displayed in the App are derived in part from third-party food and nutrition database providers. While Aslyte UG endeavours to present accurate information, no guarantee is made regarding the accuracy, completeness, or currency of such data. Actual nutritional values may vary depending on food source, preparation method, portion size, regional product variations, and other factors. Users with specific dietary requirements or restrictions should independently verify all nutritional information.

5. Supplement Information

Any information regarding dietary supplements provided within the App is strictly informational and general in nature. It does not constitute a recommendation, prescription, or endorsement of any specific supplement product or regimen. Dietary supplements may interact with medications, may be contraindicated for certain health conditions, and may carry risks of adverse effects.

You must consult a qualified healthcare professional before starting, modifying, or discontinuing any supplement regimen, especially if you are pregnant, nursing, under 18 years of age, taking prescription or over-the-counter medication, or have been diagnosed with any medical condition.

Supplement information in the App has not been evaluated or approved by the European Food Safety Authority (EFSA), the Bundesinstitut für Risikobewertung (BfR), or any other regulatory body.

6. Allergies, Food Intolerances, and Dietary Restrictions

The App allows users to indicate food allergies and intolerances to filter and personalise content. However:

• The allergy and intolerance filtering functionality is provided as a convenience feature only and must not be relied upon as the sole safeguard against allergen exposure.

• Aslyte UG does not guarantee that recipes, meal plans, or food data are free from specific allergens, even when filters are applied. Cross-contamination, undisclosed ingredients, product reformulations, and data entry errors may result in allergens being present in recommended foods.

• Users with severe or life-threatening food allergies (including but not limited to anaphylaxis) must independently verify all ingredients before consumption and maintain appropriate medical precautions (e.g., availability of prescribed epinephrine auto-injectors).

• The App does not account for all possible allergens or intolerances and should never replace the advice of an allergist, immunologist, or other specialist.

Aslyte UG accepts no liability for allergic reactions, adverse health events, or injuries arising from reliance on the App's allergy filtering or food data.

7. Physical Activity and Exercise Risks

To the extent the App provides information related to physical activity, exercise, or training in conjunction with its nutrition and weight management features, users acknowledge that:

• all forms of physical activity carry inherent risks of injury, illness, or death;

• the App's content is designed for a general athletic audience and does not replace individualised guidance from a certified sports medicine physician, physiotherapist, or qualified personal trainer;

• users should obtain medical clearance from a qualified healthcare provider before commencing or significantly altering any exercise programme; and

• users are solely responsible for exercising within their own physical limits and for discontinuing any activity that causes pain, discomfort, dizziness, or other adverse symptoms.

8. Weight Management

The App includes features related to weight loss and weight gain programmes. Users acknowledge that:

• healthy weight management should be supervised by a qualified healthcare professional, particularly for individuals with a history of eating disorders, metabolic conditions, cardiovascular disease, or other health concerns;

• calorie targets, macronutrient distributions, and dietary recommendations generated by the App are based on generalised models and may not be appropriate for every individual;

• rapid or extreme weight loss or gain may pose serious health risks; and

• the App does not diagnose, treat, or monitor eating disorders or any psychological condition related to food, body image, or weight.

9. Health Metric Tracking

Health metrics tracked through the App (including but not limited to weight, body fat percentage, and related measurements) are provided for self-monitoring purposes only. These metrics:

• do not constitute medical measurements or clinical assessments;

• may be inaccurate depending on user input, measurement methods, and device calibration; and

• should not be used to diagnose, monitor, or treat any health condition.

10. Third-Party Integrations and Data

The App integrates with third-party services, including Apple Health, Google Fit / Health Connect, wearable fitness devices, and external food and nutrition databases. Aslyte UG:

• is not responsible for the accuracy, availability, security, or reliability of data provided by or transmitted to third-party services;

• does not control or endorse the products, services, or content of any third-party provider;

• makes no representations or warranties regarding third-party services, their data handling practices, or their compliance with applicable law; and

• shall not be liable for any loss, damage, or adverse health outcome arising from reliance on third-party data or from errors, interruptions, or inaccuracies in third-party integrations.

Users are advised to review the terms of service and privacy policies of all connected third-party services independently.

11. Age Restriction

The App is intended for users aged 16 years and older. The nutritional information, calorie recommendations, and weight management features within the App have been designed with adult and older adolescent physiology in mind and may not be appropriate for younger individuals. Users between the ages of 16 and 18 are strongly encouraged to consult a parent or legal guardian and a qualified healthcare professional before using the App's features.

12. Individual Responsibility

By using the App, you acknowledge and agree that:

• you are solely responsible for your dietary choices, physical activity, health decisions, and overall well-being;

• you will seek the advice of a qualified healthcare professional before acting on any information provided by the App;

• you will provide accurate and complete information when using the App and understand that inaccurate input may lead to unsuitable recommendations; and

• you use all information, recommendations, and features of the App at your own risk.

13. Limitation of Liability

To the fullest extent permitted by applicable law, including but not limited to the provisions of the German Civil Code (Bürgerliches Gesetzbuch, BGB):

1. Aslyte UG, its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of, reliance on, or inability to use the App or any content, features, or recommendations provided therein, including but not limited to damages for loss of health, bodily injury, loss of profits, data loss, or other intangible losses.

2. In particular, Aslyte UG shall not be liable for any adverse health outcomes, allergic reactions, injuries, illnesses, or medical emergencies arising from:

   • dietary changes made based on the App's content or recommendations;

   • allergen exposure resulting from reliance on the App's allergy filtering;

   • the use of supplements based on information provided in the App;

   • physical activity undertaken in connection with the App's content; or

   • inaccuracies or errors in algorithmic recommendations, nutritional data, or third-party data.

3. Mandatory statutory liability remains unaffected. Nothing in this disclaimer shall exclude or limit the liability of Aslyte UG:

   • for damages arising from injury to life, body, or health due to a negligent or intentional breach of duty by Aslyte UG or its legal representatives or vicarious agents (§ 309 Nr. 7a BGB);

   • for other damages arising from an intentional or grossly negligent breach of duty by Aslyte UG or its legal representatives or vicarious agents (§ 309 Nr. 7b BGB);

   • for intent (Vorsatz) under § 276 BGB; or

   • for liability under the German Product Liability Act (Produkthaftungsgesetz, ProdHaftG) or other mandatory provisions of law.

4. To the extent that liability of Aslyte UG is not excluded under the preceding paragraphs, Aslyte UG's aggregate liability shall be limited to the amount of fees paid by the user to Aslyte UG in the twelve (12) months preceding the event giving rise to the claim, or EUR 100, whichever is greater.

14. No Warranties

The App and all content, features, and services provided therein are made available on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Aslyte UG does not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate, reliable, or complete.

15. Emergency Situations

The App is not designed for use in medical emergencies. If you are experiencing a medical emergency, call your local emergency number (112 in the European Union / Germany) immediately. Do not use the App to seek emergency medical assistance.

16. Changes to This Disclaimer

Aslyte UG reserves the right to modify, amend, or update this Health and Medical Disclaimer at any time and at its sole discretion. Material changes will be communicated to users through the App or by other reasonable means. Continued use of the App following the publication of changes constitutes acceptance of the updated disclaimer. Users are encouraged to review this disclaimer periodically.

17. Severability

If any provision of this disclaimer is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent.

18. Governing Law and Jurisdiction

This disclaimer shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. Mandatory consumer protection provisions of the country in which the user has their habitual residence shall remain applicable to the extent required by law.

For users who are consumers within the meaning of § 13 BGB, the courts of the user's place of domicile shall have jurisdiction. For all other users, the exclusive place of jurisdiction shall be the registered office of Aslyte UG.
